("we", "us", "our").

This End User License Agreement ("EULA") governs your use of the xLog Boating Application and of the chart data made available through it. It is the licence part of your contract with us: together with the Terms of Service it forms one contract between you and us. If we transfer that contract to another company under section 15 of the Terms of Service, this EULA transfers with it.

Your commercial relationship (subscription, price, payment, renewal, cancellation, refunds, liability and the law that applies) is governed by our Terms of Service. How we handle personal data is described in our Privacy Policy. This EULA governs your licence to the software and the Nautical Chart Data: what you may do with them, what you may not do, how long the licence runs and what happens when it expires. The Annex carries the sources of the Nautical Chart Data and the notices that the organisations supplying it require us to reproduce. Where the same subject is addressed in more than one of these three documents, the allocation above decides: the Terms of Service prevail for your commercial relationship with us, this EULA for the licence and the restrictions, and the Annex for the sources and the mandatory notices. In any event, the Terms of Service do not override the permitted purpose, the restrictions and the mandatory notices in sections 4, 7 and 12 of this EULA and in the Annex; as far as they pass on requirements of the hydrographic offices for their data, they are prescribed to us by those organisations; sections 4 and 7 state where we apply a requirement more widely.

Language. This EULA exists in a German and an English version. For contracts offered and concluded in German, the German version applies; for contracts in English, this version. The notices required by the hydrographic offices are reproduced unchanged in the language in which they are prescribed to us; any translation alongside them is marked as such and is for information only.

You accept this EULA before you use the Service. For the free plan, we show this EULA to you, together with the Terms of Service, when you register, and ask you to accept it then. Before you subscribe, we show you both documents again and ask you to accept them for your subscription. Access to the Service is not provided without a valid EULA in force.

2. Definitions

"Application" means the xLog Boating software as it runs on your side: the mobile apps for iOS and Android and the web application you open in your browser.

"Service" means the Application together with everything we make available to you through it: the chart data, your account, synchronisation between your Devices, location sharing and related content. Where these terms deal with the program on your Device or in your browser (installing it, granting permissions, removing it), they speak of the Application; where they deal with what you agree with us and use, they speak of the Service.

"Nautical Chart Data" means the nautical chart information displayed in the Application: coastal charts derived from official data supplied to us by national hydrographic offices and their coordinating organisations, and inland electronic navigational charts (Inland ENCs) obtained from the sources listed in the Acknowledgements and Notices. It does not include the base map derived from OpenStreetMap data.

"Device" means a smartphone, tablet, notebook, desktop computer or comparable personal end-user device.

"Subscription Period" means, for each subscription, the initial term of that subscription and, thereafter, each successive twelve-month billing period for which it continues, in accordance with the Terms of Service. Where you hold subscriptions for several regions or countries, each subscription has its own Subscription Period.

How the Service is provided. We provide the Service in a free plan and as a paid subscription per region or per individual country. You obtain the mobile apps from the Apple App Store or Google Play and install them on your Devices; you access the web application through our website. The free plan is provided without Nautical Chart Data, with a simplified base map derived from OpenStreetMap data; section 3 of the Terms of Service sets out what the free plan includes. With a subscription, the Nautical Chart Data of the countries you have purchased is, in the mobile apps, downloaded to the Device and displayed there without a network connection; the web application displays it online and requires a network connection. Updates to the Nautical Chart Data, synchronisation between your Devices and position sharing require a connection to our servers.

Updates during the Subscription Period. For as long as the relevant Subscription Period runs, we make updated Nautical Chart Data available to you for the countries covered by that subscription, as described in section 3 of the Terms of Service; section 6 of those Terms sets out the term and renewal, and section 9 of this EULA sets out what happens when a Subscription Period ends.

3. Licence

We grant you a non-exclusive, non-transferable, non-sublicensable licence, personal to you, to use the Service for the purpose set out in section 4:

The restrictions in section 7 and the consequences of breach in section 15 apply to each of these licences.

The licence applies worldwide, with the exception of territories that are from time to time subject to export restrictions, embargoes or sanctions of the European Union, the United Nations or the United Kingdom. You must not use the Service in such a territory. We show you the areas excluded at any given time in the Application and on our website. If an area is newly excluded during the term of your subscription and this impairs your use more than insignificantly, we inform you of this on a durable medium; you may then terminate the contract free of charge within 30 days in accordance with section 3 of the Terms of Service (refund: section 6 of the Terms of Service). A breach of this paragraph that you neither knew of nor ought to have known of is not a serious breach for the purposes of section 15.

The licence is granted to one natural person. You may use the Service on up to five Devices that you own or control. If you want to use a sixth Device, you can release a place when you sign in on that Device; if you want to remove a Device for any other reason (for example because it has been lost, sold or is no longer in use), we release the place for you on request at support@xlog-boating.com. Simultaneous use by more than one person is not permitted; we check this by technical means. Releasing a Device's place does not remove the Application or your content from that Device. Before you sell or otherwise pass on a Device, sign out of the Application on it and delete the Application.

You must keep your access credentials confidential and must not share them or allow anyone else to use your account.

All rights not expressly granted in this EULA are reserved.

4. Permitted purpose

You may use the Nautical Chart Data only for non-regulated navigation, that is, for determining position and for planning, recording and controlling the movement of vessels that are not subject to the SOLAS Convention and not subject to the Code of Practice of the United Kingdom's Maritime & Coastguard Agency (MCA), which applies to small commercial vessels. Recreational craft in private use are as a rule subject to neither. If your vessel is used commercially (for charter, for training or for carrying passengers), check first whether one of them applies to you. The limits relating to the SOLAS Convention and to the MCA Code of Practice go back to requirements of individual hydrographic offices for the chart data they supply; we apply them to all Nautical Chart Data because the Service does not separate the data of the individual offices in use (section 7 nos. 3 and 4 follow the same approach).

The other functions of the Service (such as the on-board library, boat details, tasks and expenses) do not use Nautical Chart Data. You may use them to manage your own vessel.

You must not use the Service as a replacement for an ENC in an ECDIS.

5. What the Service is and what it is not

Please read this section with particular care. Anyone who sees nautical charts on a screen easily assumes that they can navigate with them alone and that the charts are complete, up to date and verified. For xLog Boating that is expressly not the case; the following points set out where the limits lie. Because the Service departs here from what you might otherwise expect, we specifically draw your attention to this before you make your contractual declaration and ask you to confirm these points expressly and separately: when you register for the free plan and again before you take out a subscription. With your confirmation they become part of the agreed characteristics of the Service.

xLog Boating is a supplementary aid for non-regulated navigation, typically recreational craft in private use; the permitted purpose is set out in section 4.

You remain responsible for the navigation of your vessel. You must plan and conduct passages using official charts and publications and using appropriate seamanship, and must not rely on the Service as your only source of navigational information.

6. Position sharing, mooring watch and anchor alarm: not emergency services

These functions too have limits you might not expect: position sharing, the mooring watch and the anchor alarm do not work without gaps and are not emergency services. The following points form part of the description you confirm separately under section 5.

The Service allows you to share the live position of an active trip by means of a link that you distribute yourself.

Mooring watch and anchor alarm. The Application can monitor the position of your Device while your vessel is moored or, when you switch the anchor alarm on and set an alert range, while you are at anchor, and can notify you when the position leaves that range.

You remain responsible for your vessel. Keep an anchor watch appropriate to the conditions and check your position by other means; do not rely on the Service as the only safeguard against dragging or drifting.

7. Restrictions

You must not:

  1. sell, rent, lend, sublicense, distribute or otherwise transfer the Service, the Nautical Chart Data or any part of either to any third party;
  2. tamper with, reverse engineer, decompile, disassemble or modify the Service, the Nautical Chart Data or any technical protection measures. This does not apply to acts that the law allows you to carry out whatever this EULA says. These include in particular: making a backup copy of the software where that is necessary to secure your future use of it; observing, studying and testing how the software functions in the course of using it as permitted; carrying out acts necessary for the intended use of the software, including correcting an error where we do not remedy it within a reasonable time; decompiling the software so far as necessary to achieve interoperability with other software; and using insubstantial parts of the Nautical Chart Data where that does not conflict with its normal exploitation and does not unreasonably prejudice the legitimate interests of the rightholders. This list is not exhaustive; whatever mandatory law permits you to do remains available to you in every case;
  3. systematically extract or re-use the Nautical Chart Data, or access it other than through the Service, beyond what no. 2 allows. This restriction goes back to a requirement of one of the hydrographic offices for the chart data it supplies; we apply it to all Nautical Chart Data because the Service does not separate the data of the individual offices in use (section 4 follows the same approach);
  4. use the Nautical Chart Data as part of, in connection with or for the purpose of an artificial intelligence system, in particular to train, develop, fine-tune or evaluate one, or to extract, copy or scrape the Nautical Chart Data for any of those purposes. Artificial intelligence system here means a system within the meaning of Article 3(1) of Regulation (EU) 2024/1689 (the AI Act); for the purposes of this restriction the same applies to an artificial intelligence model, including a general-purpose AI model within the meaning of Article 3(63) of that Regulation and any large language model. This restriction goes back to a requirement of one of the hydrographic offices: it requires us to pass it on for the chart data it supplies, and we have no room to narrow it there. We apply it to all Nautical Chart Data because the Service does not separate the data of the individual offices in use, and for all Nautical Chart Data we also reserve our rights under section 44b(3) of the German Copyright Act (UrhG). What it is aimed at is the use of the chart data itself in such a system. It does not restrict your ordinary use of the Service for navigation and voyage planning on a device or operating system that itself includes artificial intelligence features, and it does not restrict the functions the Service provides to you;
  5. remove, alter, obscure or abbreviate any of the acknowledgements, notices or copyright statements displayed in the Application or set out in the Annex.

Open-data exception. Some data displayed in the Application is supplied to us under open licences: the base map derived from OpenStreetMap data (Open Database License 1.0) and certain Inland ENC datasets (for example CC BY 4.0 or CC0); the sources and licences are listed in the Annex. For that data, the terms of its open licence take precedence over this Agreement as a whole, including sections 3 and 9: nothing in this EULA restricts what the applicable open licence permits you to do with that data as obtained from its original source, or with the databases derived from OpenStreetMap data that we ship with the Application or provide to you on request, which we make available under the ODbL (the Annex says how you can obtain them). For Inland ENC data published under CC BY 4.0, the same applies to its contents in the form in which the Application displays them, because that licence does not allow us to add restrictions to it. This Agreement continues to apply to the Service as a whole and to all other Nautical Chart Data.

8. Copies, screenshots and backup

Screenshots and paper printouts of displays of the Nautical Chart Data (for example a screen capture taken by means of your operating system, or a printed screenshot) are for your own personal use only; printouts may be made only up to DIN A3 size. They are not suitable as a navigational aid and must not be sold, rented, transferred or otherwise made available to third parties. Section 7 no. 2, last item (use of insubstantial parts of the Nautical Chart Data), remains unaffected.

You may make one complete copy of the xLog Boating Application for archive or backup purposes. The Nautical Chart Data is not part of that copy: you hold it as one working copy that you may use on up to five Devices (section 3), and you can download it again at any time for as long as your subscription or your free trial runs.

Backups which the operating system of your Device creates automatically (such as device or cloud backups) do not count towards this and are not a breach of this EULA. Your statutory right to make further backup copies of the software, to the extent necessary to secure your future use (section 7 no. 2), remains unaffected.

The Annex to this Agreement carries the information that one of the organisations supplying the Nautical Chart Data requires us to give you in writing about copyright and its enforcement (Acknowledgements and Notices, section 7). Your right under this section to make one complete copy of the Application for archive or backup purposes is unaffected.

9. Term, renewal and expiry

Your licence to the Nautical Chart Data is granted per purchased region or country and for a maximum of twelve months at a time: it runs for the current twelve-month period of the relevant subscription and is renewed for a further twelve months whenever a new billing period of that subscription begins, and whenever a licence period ends while that subscription is still running. No licence to Nautical Chart Data is granted for a period longer than twelve months. The licence for the free plan (section 3) is independent of this: it continues for as long as the contract about the free plan continues, and at the latest until your account is deleted.

The end of the current period is shown to you in the Application, and we notify you at least one month before a licence period ends or a new twelve-month period begins.

When a subscription expires or is terminated, then for the Nautical Chart Data covered by it:

Your own content. Trips, tracks, routes, logbook entries and the other content you have created, uploaded or imported in the Service (such as documents and photos in the on-board library, boat details, tasks and GPX files) are yours, and this content is stored with us in readable form. We use your content to provide the Service to you, to keep it secure and to enforce these terms, and as far as necessary to comply with a legal obligation or to establish, exercise or defend legal claims. Beyond that, we may create combined, anonymous evaluations from the content of all users (such as frequently travelled routes or popular anchorages) and use them in the Service and elsewhere, for example in statistics we publish; such evaluations do not allow any conclusion about you, your vessel or individual trips. Before we start doing so, we describe it in the Privacy Policy. After this EULA ends we use your content only as far as necessary to comply with a legal obligation or to establish, exercise or defend legal claims, and only for as long as that requires; we do not include it in new evaluations, but what has by then gone into anonymous evaluations and can no longer be separated from them remains part of them.

Getting your content. As long as you have access, you can export your content yourself in the Application at any time. In every case (including during a suspension and after this EULA has ended, until deletion under this section) we provide it to you directly at your request. Both are free of charge, without hindrance, within a reasonable time and in a commonly used, machine-readable format. This applies to your own content only, not to the Nautical Chart Data. A live position you share is not stored as separate content: it is delivered for as long as section 6 describes, and the positions of a recorded trip are part of that trip.

How long your own content remains available. When a subscription ends, your account continues on the free plan of the Service (section 3 of the Terms of Service), unless the contract as a whole ends, and your content remains in your account. Content above the free plan's limits remains readable and exportable for 90 days after the end of your last subscription period and is then deleted: the 50 most recent logbook entries and the most recent documents up to 100 MB remain, the older surplus is removed. We remind you by email before the deletion and point to the export described above; if a new subscription begins within the 90 days, nothing is deleted. The same applies where the limits of the free plan are lowered (section 13 of the Terms of Service): content above the new limits remains readable and exportable for 90 days after the change takes effect and is then deleted under the same rule.

Accounts that are no longer used, and closed accounts. We delete an account that you have not used for twelve months (no sign-in and no use of the Service with the account) while no subscription was active during that time, together with the data stored in it; we notify you by email at least 30 days before the deletion, and any use of your account before that date prevents it. Where we close your account (section 13 of the Terms of Service), you can no longer sign in from that date; we provide your content to you on request as described above until it is deleted 90 days after the closure, or earlier if you ask us to. Section 3.4 of the Privacy Policy describes this in detail.

What continues to apply. The restrictions in section 7, the mandatory notices in section 12 and the reservation of rights in section 11 continue to apply after a subscription ends and after this EULA ends, until access to the Nautical Chart Data is disabled as described above; where you have no such access, they end with this EULA. After that, the limits that copyright law itself sets apply. The rules in the first paragraph of section 8 and the restriction in section 7 no. 4 continue to apply to screenshots, printouts and other copies of Nautical Chart Data that you keep, for as long as you keep them. Nautical Chart Data still held on a Device can no longer be used once access to it has been disabled as described above; you remove it by deleting the Application.

10. Free trials

Where we offer you a free trial before your first paid subscription (section 6 of the Terms of Service), it lasts fourteen days and is available once per customer; the trial licence ends automatically when the trial ends.

During the trial the Application is marked "NOT FOR NAVIGATION".

Whether the Service continues after the trial is governed by the Terms of Service: unless you cancel before the trial ends, it converts into a paid subscription, and this EULA then applies for the Subscription Period. The conditions and the price are shown to you before the trial starts.

11. Intellectual property

This EULA does not grant you any right, title or interest in the intellectual property or goodwill of the hydrographic offices, their coordinating organisations or their data providers, including the copyright in the Nautical Chart Data.

You may not use the names, trade marks, logos or other distinguishing features of any of those organisations in a way that suggests that the Service originates from them or is endorsed by them. Simply naming them (for example in a review or when you contact support) is not affected.

Third-party components. The Application includes software components from third parties that are made available under their own licences, most of them open-source licences. Those licences apply to the components concerned and, where they grant you rights that go beyond this EULA, they take precedence for that component. They do not impose obligations on you towards us beyond this EULA. The copyright notices and licence texts are available to you in the Application under "Licences".

Open data. The copyright and database rights in the open-licensed data displayed in the Application remain with its rightholders, except where the applicable licence waives them, as CC0 1.0 does; the notices are set out in the Annex and in the Application. Section 7 says which data this is and how its licences rank against this EULA.

Further data sources. Where we extend the Service with data from further sources, such as weather or wind data, the terms and notices of their rightholders apply to that data in addition. We show them to you before you first use the feature and ask for your agreement at that point; they are also set out in the Annex. Your rights in the Nautical Chart Data are not affected. If you do not use the feature, those terms do not apply to you.

12. Mandatory notices

The organisations that supply the Nautical Chart Data require us to reproduce certain statements word for word. These mandatory notices, including the statement on ENC Data issued by government authorities (Annex section 2) and the notices for Belgium, the Netherlands and Türkiye (Annex section 5), are set out in the Annex. Each of them is a statement made by the organisation that requires it. They are not statements or acknowledgements by you, they do not form part of what you agree to, and they do not affect any right you have against us.

The complete Acknowledgements and Notices (including the mandatory notices, the source acknowledgements, the warnings of the hydrographic offices and the list of Custodian Organisations) form part of this EULA and are reproduced in full in the Annex.

13. No endorsement

The statement that none of those organisations endorses the Service, and that nothing in the Service is intended to suggest that it originates from or is equivalent to a product of any of them, is set out in the Annex, section 6.

14. Warranty and liability

Your statutory rights are not affected. As a consumer you have statutory rights in respect of digital content and digital services, in particular under sections 327 et seq. of the German Civil Code (BGB), which implement Directive (EU) 2019/770, and, if you are habitually resident in another state, under the mandatory provisions of the law of that state (section 19). Nothing in this EULA limits or excludes those rights.

What conformity is measured against. Whether the Service is in conformity with the contract is determined by the applicable law (section 11 of the Terms of Service). The Service is supplied as described in sections 5 and 6; those descriptions form part of the agreed characteristics of the Service, and we ask you to confirm them separately before you make your contractual declaration (section 5).

Statements of the hydrographic offices. The mandatory notices in the Annex are statements of the hydrographic offices and do not exclude or limit our liability towards you (section 12).

Where our responsibility lies. What we owe you in respect of the Nautical Chart Data is described in section 5.

Liability. Our liability is governed by section 12 of the Terms of Service. That section applies to everything you receive from us, including the software and the Nautical Chart Data. This EULA does not limit our liability separately.

15. Suspension and termination

Breach. We may suspend your access to the Service, or terminate this EULA, where you seriously or repeatedly breach this EULA or the Terms of Service. A breach of section 4 that you neither knew of nor ought to have known of is not a serious breach for these purposes; the suspension described in the next paragraph remains possible. Unless the breach is so serious that we cannot reasonably be expected to wait, we first ask you in text form to stop the breach and allow you a reasonable period to do so.

Suspension required by a chart data supplier. Where we are obliged towards one of the organisations that supply the Nautical Chart Data to suspend immediately once a breach of sections 4, 7 or 8 has been identified, we suspend without asking you first (but then only your access to the Nautical Chart Data, not to your own content or the other functions of the Service), and we make up for the request without undue delay. Where we establish a breach of this EULA that concerns the Nautical Chart Data or the licence to it (sections 3, 4, 7, 8 and 11), or that someone else has used your account or the Nautical Chart Data without authority, we report it to the organisation that supplies the data concerned where our licence agreement with that organisation obliges us to do so; the report is pseudonymous (section 9 of the Privacy Policy).

Suspension for other reasons. We may also suspend your access temporarily where there are signs that someone else is using your account without your knowledge, or where your account poses a risk to the security of the Service; we notify you at once and lift the suspension as soon as your account is secure again. Where a payment you owe for your subscription is charged back or is not made when due, we may suspend access to the Nautical Chart Data it covers until the payment has been made or it is established that the amount was not owed; your own content and the free plan are not affected. Irrespective of any breach, we suspend access to the extent and for as long as a law, a sanctions rule or an order of a public authority prohibits us from providing the Service to you, for example in a territory excluded under section 3.

Procedure and consequences. We tell you the reason (with the statement of reasons and the means of redress described in section 10 of the Terms of Service), we limit any suspension in scope and in time to what is necessary to address the breach or the other reason for it, and we lift it as soon as the reason no longer applies. A suspension or termination does not affect your rights to your own content; we provide it to you at your request as described in section 9. You owe no payment for a period of suspension for which you are not solely or very predominantly responsible (section 5 of the Terms of Service). Where we terminate this EULA, the contract as a whole ends at the same time, including the free plan, and we close your account; section 13 of the Terms of Service governs the consequences (refund: section 6 of the Terms of Service). Your statutory rights, including your right to terminate the contract, are unaffected.

Our right to terminate your subscription or the free plan on notice is governed by section 13 of the Terms of Service; where your subscription ends on that basis, the licence to the Nautical Chart Data it covers ends as set out in section 9.

The availability of Nautical Chart Data depends on our licences with the hydrographic offices. If one of those licences ends for reasons that have nothing to do with you, we do not terminate this EULA for that reason, but the areas covered by the Service may change; your access to the nautical chart data covered by that licence continues, with the last data we received, for the remainder of the billing period you have paid for and at most for twelve months, for as long as we remain permitted to provide that data. Section 3 of the Terms of Service sets out what happens then and what rights you have.

16. Changes to this EULA

We may amend this EULA where there is a valid reason, namely:

  1. a change in the applicable law or in the case law of the highest courts, or a court decision that binds us, affects a provision of this EULA;
  2. an app store through which the Service is sold changes the requirements it sets for end user licences;
  3. the organisations that supply the Nautical Chart Data change their requirements for end user licences and we are contractually obliged to reflect those changes;
  4. we add data from a further source to the Service that cannot be offered as a feature of its own under section 11 and whose licence requires us to pass terms or notices on to you.

We may not use this section to change the main subject matter of the contract, that is, your licence to use the Nautical Chart Data you have paid for, for navigation, on your Devices and, in the mobile apps, without a network connection, and, on the free plan, your licence under section 3; this definition applies to the whole contract, including the Terms of Service. To that extent an amendment takes effect only with your express agreement. The price is governed by section 7 of the Terms of Service and changes to the coverage by section 3 of the Terms of Service. An amendment made for reason 4 may not narrow your rights in the Nautical Chart Data. Where a change to the Service under section 3 of the Terms of Service alters a description of the Service in this EULA, that description changes with it without an amendment under this section; this does not apply to the main subject matter of the contract.

How we tell you. We notify you of any change in text form, to the email address of your account (section 5 of the Terms of Service), at least two months before it is to take effect, stating what changes, why, and from when.

When a change takes effect. A change made for one of the reasons 1 to 3 above takes effect on the date stated in the notification unless you reject it before that date (see "If you do not respond"). A change made for reason 4 takes effect only when you agree to it; we ask for your agreement in the Application, at the latest before the start of the next twelve-month billing period. If you reject a change, this EULA continues to apply unchanged. Where we amend this EULA for one of the reasons 1 to 3, you may terminate your subscription free of charge up to the date stated in the notification, with immediate effect or with effect from that date (refund: section 6 of the Terms of Service).

If we cannot continue under the unchanged EULA. If we cannot continue to provide the Service under the unchanged EULA because the organisations that supply the Nautical Chart Data have changed their requirements (reason 3), we may terminate your subscription with effect from a date we state in the notification: at the earliest the date the change would have taken effect, and at the latest the end of the twelve-month billing period then running. Where those organisations leave us less time, we may terminate with effect from the date on which we may no longer provide the Service under the unchanged EULA, but no earlier than six weeks after our notification (refund: section 6 of the Terms of Service). Your account then continues on the free plan; where the change concerns the free plan as well, we may terminate the free plan only under section 13 of the Terms of Service.

If you do not respond. Where we amend this EULA for one of the reasons 1 to 3 above, your agreement is deemed given if you do not notify us of your rejection before the date on which the change takes effect; that date is at least two months after you receive the notification. We draw your attention specifically to this meaning of your silence in that notification. This does not apply to an amendment made for reason 4, nor to the main subject matter of the contract, nor to a change that would make the Service deviate from the objective requirements of the applicable law in a way that sections 5 and 6 do not already describe; such a change applies to you only if you agree to it expressly and separately (section 5).

Corrections and improvements. We correct obvious errors, and we make changes that only give you additional rights, without following the procedure above; we tell you in the Service. This applies only as long as the change alters neither your rights and obligations to your disadvantage nor the agreed characteristics of the Service.

Mandatory notices. The mandatory notices in the Annex are not part of what you agree to (section 12). If one of those organisations changes the wording of its notice, or a notice is added, we replace or add it in the Application and in the Annex without undue delay. This is not a change to this EULA within the meaning of this section, as long as it changes neither your rights and obligations nor the agreed characteristics of the Service; otherwise the procedure above applies.

Accounts without a current subscription. If you use only the free plan, the same procedure applies. Where a change needs your express agreement, we ask for it the first time you sign in after the two months have passed. If you reject a change made for one of the reasons 1 to 3, your licence for the free plan ends on the date the change would have taken effect and we close your account (section 13 of the Terms of Service); if you reject a change made for reason 4, this EULA continues to apply unchanged, and we may terminate the free plan only under section 13 of the Terms of Service. You can delete your account at any time (section 5 of the Terms of Service).

17. Mandatory consumer rights prevail

Where any provision of this EULA conflicts with mandatory consumer protection law applicable to you, that law prevails. The statutory rule takes the place of the provision; the remaining provisions stay in effect unless holding to the contract would be an unreasonable hardship for one of us.

18. Channel-specific terms

Only the Apple App Store requires us to include additional licence terms. If you obtained the Service through Google Play or through our website, purchase, payment and invoicing are handled by the merchant of record for that channel under that provider's own terms, which apply between you and that provider, as are the refunds it grants under its own rules; the refunds we owe you under sections 6 and 8 of the Terms of Service are not affected. Section 7 of the Terms of Service sets out who that is in each channel and how it works. This EULA governs your use of the Service and your rights against us in every channel alike and is not affected by those terms.

18.1 Apple App Store

The following applies if you obtained the Service through the Apple App Store.

Apple requires us to include the following terms. They describe the relationship between you, us and Apple. They do not limit the rights you have against us under this EULA, under the Terms of Service or under the law, in particular your rights as a consumer if the Service is not in conformity with the contract, which you can always raise with us directly. The representations in paragraphs 7 and 9 are required by Apple; they are statements towards Apple. We do not rely on them as evidence against you, we attach no liability of our own to them, and we derive no rights from them, in particular no suspension and no termination under section 15. Paragraph 10 is likewise required by Apple. It does not add to your obligations under this EULA and does not affect your rights against us.

  1. This EULA is concluded between you and us only, not with Apple. We alone are responsible for the Service and its content.
  2. The licence granted in section 3 applies to Apple-branded products that you own or control. This is Apple's requirement for the mobile app you download from the App Store; your use of the Service on other Devices and in the browser under sections 2 and 3 is not affected. Apple requires us to state that the Usage Rules set out in the Apple Media Services Terms and Conditions also apply; you can find them at https://www.apple.com/legal/internet-services/itunes/. As between you and us, section 3 governs: the licence is for one person and up to five Devices. The Usage Rules do not extend it, including through Family Sharing, and do not reduce any right you have against us.
  3. Maintenance and support for the Service are provided by us alone. Apple has no obligation whatsoever to furnish any maintenance and support services.
  4. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our responsibility.
  5. We, not Apple, are responsible for addressing any claims relating to the Service, including product liability claims, any claim that the Service fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
  6. We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the Service infringes intellectual property rights.
  7. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Our name, address and contact details are set out in section 1.
  9. You must comply with applicable third-party terms of agreement when using the Service, including the terms of your wireless data service agreement.
  10. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, have the right to enforce it against you.

19. Governing law

This EULA is governed by German law. If you are a consumer habitually resident in another country, you additionally enjoy the protection of the mandatory provisions of the law of that country; the choice of German law does not deprive you of that protection.

Annex: Acknowledgements and Notices

The following Acknowledgements and Notices form part of this EULA. The notices whose wording is prescribed to us are reproduced unchanged, in the language in which they are prescribed, because the licence agreements mandate their wording and prohibit changes; the explanatory framing text around them is our own. The introduction to section 12 explains the status of the prescribed notices: they are statements of the organisations that supply the Nautical Chart Data, not statements or acknowledgements by you.

1. Chart data sources

xLog Boating displays nautical chart information derived from official data supplied by national hydrographic offices under licensing arrangements, inland electronic navigational charts (Inland ENCs) obtained from the sources listed below, and a base map derived from OpenStreetMap data. The tables below show which source covers which area.

Nautical charts (hydrographic offices).

Area Chart data supplied through
Germany Bundesamt für Seeschifffahrt und Hydrographie (BSH)
Belgium, Denmark, Faroe Islands, Greece, Montenegro, Netherlands, Türkiye IC-ENC
Bosnia and Herzegovina, Croatia, Gibraltar, Guernsey, Iceland, Ireland, Isle of Man, Jersey, Malta, Portugal, Slovenia, Spain, United Kingdom United Kingdom Hydrographic Office (UKHO)
Estonia, Finland, Latvia, Lithuania, Norway Norwegian Mapping Authority, Hydrographic Service (NHS) through PRIMAR

Inland ENCs (inland waterways).

Area Inland ENCs obtained through Licence
Austria, Bulgaria, Croatia, Czechia, France, Hungary, Luxembourg, Romania, Serbia, Slovakia; Belgium (Flanders) EuRIS (eurisportal.eu) no licence named by the source; use of the EuRIS interface released for this purpose
Germany (federal waterways) EuRIS and ELWIS (www.elwis.de) GeoNutzV (German federal ordinance on the terms of use for federal geodata)
Netherlands EuRIS and vaarweginformatie.nl CC0 1.0 (dataset of Rijkswaterstaat)
Belgium (Wallonia) EuRIS and the Géoportail de la Wallonie CC BY 4.0
Belgium (Brussels port area) EuRIS and port.brussels CC0 1.0

We rely on the licence stated in this table only for the data we obtain directly from the source named in that row (ELWIS, vaarweginformatie.nl, the Géoportail de la Wallonie, port.brussels), and on the EuRIS release alone for all data we obtain through EuRIS, whichever authority issued the cell. This does not limit what the licence of the authority publishing a cell allows you to do with it, however we obtained it.

Neither the data sources nor EuRIS give any warranty for the correctness or up-to-dateness of Inland ENC data. It is provided for information purposes and is not an official Inland ECDIS chart; some datasets are updated rarely or not at all, and the Hungarian cells are published by their source for test purposes. The Application shows the issue date of each chart cell.

Source notices for Inland ENCs. The Inland ENC data has been converted and rendered by us for display in the Application and has been modified from the original datasets. The following notices apply:

Base map (OpenStreetMap). The base map and the offline place database are derived from OpenStreetMap data: © OpenStreetMap contributors, licensed under the Open Database License 1.0 (openstreetmap.org/copyright; licence text at https://opendatacommons.org/licenses/odbl/1-0/). The data has been modified and rendered by us. The offline place database that we ship with the Application is a derived database in the sense of that licence and is itself available under it: you may use, share and adapt it under the terms of the ODbL. It is included with the Application in machine-readable form, together with a notice naming the licence and that address, and we also send you a copy on request at support@xlog-boating.com. The database from which we render the base map is likewise a derived database under the ODbL and is itself available to you under it: on request at the same address we provide you, free of charge, with that database in machine-readable form, together with the licence notice, or with a description of the changes we made to the OpenStreetMap data and of how we produced it, including the import and filter configuration we use.

Open-data content remains subject to its own licence; nothing in the EULA restricts what those licences allow with that data as obtained from its original source, with the two databases derived from OpenStreetMap data described above, or, for data published under CC BY 4.0, with its contents as displayed in the Application (section 7 of the EULA). Apart from that, the data as converted and rendered for display in the Application remains subject to the EULA.

The tables show which source supplies the data for which area, so that you can distinguish between chart data originating from different sources; the exact extent of the area a subscription covers is shown to you on the map when you purchase it. They describe the coverage as at the date stated at the top of this document. The covered areas can change during your subscription, for example when a licence with a hydrographic office begins or ends or a data source ceases to be available. Section 3 of the Terms of Service describes how we inform you of such changes and the rights you then have; the tables themselves are not a promise that the coverage will remain unchanged.

2. Status of the data

The following statement is reproduced word for word as required by one of the organisations that supply the chart data. It is a statement made by that organisation about the position of the authorities that issue ENC Data. It is not a statement or acknowledgement by you, it does not form part of what you agree to, and it does not affect any right you have against us.

This Service includes (but is not limited to) content based on ENC Data issued by government authorities. The Parties acknowledge and agree that whilst the relevant government authority has confidence in the ENC Data issued, once it is issued and converted into other formats, the relevant government authority has no further control over the said data or the service that is provided to users. This includes, but is not limited to representation, display, completeness, up-to-datedness, or accuracy.

xLog Boating is not an official nautical chart or nautical publication within the meaning of SOLAS Chapter V, Regulation 2, paragraph 2, it is not an Electronic Navigational Chart (ENC) and not equivalent to one, and we do not offer or describe it as one; and it is not an ECDIS. It does not satisfy any statutory carriage requirement, and official charts and nautical publications remain necessary.
